Employers must pay their employees a wage not less than the amount of the hourly state minimum wage for all hours worked in Florida. Employers must pay a direct hourly wage of $3.77 as of January 1, 2008 for "tipped employees" who meet the eligibility requirements for the tip credit under the FLSA. Each employer who must pay the FL minimum wage must prominently display a poster in a conspicuous, accessible place to employees. Members may download the poster, free of charge, from the Resources section of the IER website (under Posters/Florida Posters). A FL employer required to pay employees the federal minimum wage must post both federal and state posters because FL minimum wage does not apply unless the employee would first be entitled to the federal minimum wage. The Federal Posters are also available for members to download, free of charge, from the Resources section of the website.
